Terms of Use
Version 2026-10-17
These Terms of Use govern your use of the GEM Dental Design platform (app.gemdentaldesign.com) and the design services offered through it. GEM Dental Design is operated by TIE LAB LLC, a Delaware limited liability company ("GEM", "we"). By creating an account, activating a team invitation or clicking "Accept" in the platform, you agree to these terms on your own behalf and on behalf of the practice you represent.
1. Who can use the platform
Dentist accounts are for licensed dental professionals and their practices. Assistant accounts act on behalf of the dentist who invited them, within the permissions that dentist grants. Designer accounts are for the design professionals GEM works with.
You are responsible for keeping your credentials confidential, for everything done with your account and for the people you invite to your team. Use two-step verification where available and tell us immediately at hello@gemdentaldesign.com if you suspect unauthorized access.
2. The service and clinical responsibility
GEM provides digital dental design services (such as smile designs, restorations, wax-ups and implant surgical guides), CBCT segmentation and related software tools. Designs and outputs are proposals prepared from the information and files you provide.
You keep full clinical responsibility for diagnosis, treatment planning and for reviewing and approving every design, guide or output before any clinical use. Nothing we deliver is medical advice or replaces your professional judgment.
Some features use automated or artificial-intelligence tools, such as CBCT segmentation and the "Improve with AI" option for case notes. Their results can contain errors and must always be reviewed by you.
3. Patient information
When you submit cases you may share patient health information. Share only the information needed for the case. You confirm that you are allowed to share it with GEM for this purpose, including any patient consent or notice that applicable law requires, and you remain responsible for complying with the data protection and health privacy laws that apply to your practice.
4. How we handle patient information
GEM uses the patient information you share only to provide, support and improve the services you request and to meet its legal obligations. GEM does not sell patient information.
We protect it with administrative, technical and physical measures appropriate to its sensitivity, such as encrypted connections, role-based access and records of who accesses patient data. No system is completely secure; if we become aware of unauthorized access to your patients' information, we will let you know without unreasonable delay.
When our relationship ends, we will return or delete the patient information we hold for you where feasible, except where we must keep it by law.
5. Fees and payment
Prices are shown before you submit a case and may include negotiated prices or discounts agreed with you. Payments are processed by Stripe or by bank transfer as indicated on your proforma or invoice. Unpaid balances may delay delivery of designs.
6. Ownership and licences
You keep ownership of the patient data and files you upload. You grant GEM the right to use them only to provide and support the services and as described in section 4.
Once paid, you may use the designs delivered for your case for the treatment of that patient. GEM keeps all rights in its platform, software, templates, design libraries and know-how.
7. Acceptable use
Do not upload content you are not allowed to share, attempt to access other users' data, interfere with the platform's security or operation, reverse engineer the software, or use the platform for any unlawful purpose. We may suspend accounts that put patients, other users or the platform at risk.
8. Retention
We keep case records, files and audit logs for as long as needed to provide the services and to meet legal, tax and regulatory obligations, and then delete or de-identify them. You can ask us to close your account at hello@gemdentaldesign.com; patient information is then handled as described in section 4.
9. Disclaimers and limitation of liability
The platform and services are provided "as is". To the maximum extent permitted by law, GEM is not liable for indirect, incidental, special or consequential damages, or for clinical outcomes, and its total liability for any claim relating to a case is limited to the amount you paid for that case. Nothing in these terms limits liability that cannot be limited by law.
10. Changes to these terms
We may update these terms. When the change is material we will publish a new version and ask you to accept it in the platform before you continue using it. The version you accepted, and when, is recorded in your account.
11. Governing law
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. The state and federal courts located in the State of Delaware have exclusive jurisdiction, unless the law of your country requires otherwise.
