Terms of Use – GEM Dental Design
1. Introduction
Welcome to GEM Dental Design, a platform operated by TIE LAB LLC (“GEM,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of GEM’s digital platform for dental case design management and digital workflow collaboration (the “Services”).
By creating an account or using the Services, you agree to these Terms. If you do not agree, you may not use GEM Dental Design.
2. Accounts and Membership
Accounts are available to both individual dentists and clinics/organizations.
Accounts are free. Certain services may involve payments (see Section 5).
You are responsible for ensuring the accuracy of your account information and maintaining the security of your access. GEM is not responsible for unauthorized use of your account.
Account sharing is permitted, but you remain responsible for all activity under your account.
3. Payments and Refunds
Payments for Services are processed via Stripe or bank transfer.
Refunds are not guaranteed and may be granted on a case-by-case basis at GEM’s discretion.
4. Use of Services
You may use the Services only for their intended purpose: dental case design management and digital workflow collaboration.
You agree not to:
Resell, sublicense, or redistribute the Services.
Misuse the platform or use it for unlawful purposes.
Attempt to hack, reverse engineer, or bypass the platform’s systems.
Upload non-dental or unrelated content.
Interfere with platform security or functionality.
Disclaimer: GEM Dental Design provides tools and designs but is not responsible for clinical decisions or treatment outcomes. The treating dentist remains fully responsible for all patient care.
5. User Content and Case Files
Ownership of Uploads: Dentists (or clinics) own all files they upload (STL, DICOM, images). GEM only uses these files internally for statistics, service development, and improvement.
Ownership of Designs: All designs and outputs created by GEM or its designers are owned by GEM Dental Design. Dentists receive a right to use the final designs for treatment purposes.
AI Training: You grant GEM the right to use anonymized files for research, training, and AI model development.
Consent: You may not upload any patient-identifiable information unless you have obtained the necessary patient consents.
6. Privacy and Communications
GEM is not currently committed to GDPR/HIPAA frameworks, but users are responsible for ensuring proper handling of patient data.
By creating an account, you consent to receive marketing emails, newsletters, and promotions. You may opt out at any time via unsubscribe links or by contacting GEM.
7. Disclaimers and Limitations
The Services are provided “as is” and without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
GEM does not warrant that the Services will be error-free, uninterrupted, or meet your specific requirements.
GEM is not liable for treatment outcomes, as the dentist is solely responsible for clinical use of designs.
GEM does not guarantee continuous access to the platform and is not responsible for technical issues or interruptions.
8. Termination and Suspension
GEM may suspend or terminate your account for breach of these Terms, misuse of the Services, or non-payment.
GEM may provide notice before termination, but reserves the right to act immediately if necessary.
9. Non-Solicitation
You agree not to solicit, contract with, or employ GEM’s designers, directly or indirectly, during your use of the Services and for 24 months after termination of your account.
10. Governing Law
These Terms are governed by the laws of the United States. The specific jurisdiction and court may be designated in future updates.
11. General Provisions
Entire Agreement: These Terms constitute the entire agreement between you and GEM regarding the Services.
Severability: If any part of these Terms is held invalid, the remaining provisions remain enforceable.
Changes: GEM may update these Terms at any time by posting changes. Continued use of the Services constitutes acceptance of the new Terms.
